US Court Mandates Release of Kilmar Abrego Garcia from Immigration Custody
A federal judge has ordered the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued confinement lacks lawful basis.
"Since Abrego Garcia's release after wrongful imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her ruling.
The situation originates in a erroneous removal to El Salvador in March, which the government later admitted was an error. After his repatriation to the United States to answer alien smuggling charges, he was detained in immigration custody.
In her decision, the court noted that the authorities lacks a current deportation order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."
